Privacy Notice

Respecting your data privacy rights is our top priority. This notice explains the rationale and manner of how we collect personal data about you, how we process those data, and the rights you have in protecting your personal data. 

Data privacy as contained in this policy is governed by the RA 10173 – Data Privacy Act of 2012.

Control of Your Personal Data

PIEMPI is responsible for your personal data. For applicable data protection law, the sole  controller of your data will be PIEMPI who is providing services or communicating with you.

Personal Data We Collect From You and How We Obtain It

Following are the categories of personal data we request that you provide us, if necessary or needed in the course of interaction with us:

  • The contact information you share with us: name, title, job title, email address, business address, telephone number, mobile telephone number

  • Additional information you furnish us in the course of our business relations, such as: interests in PIEMPI services, marketing preferences, registration information we obtain in the organization’s activities such as: members’ forum, events, trainings, contracts, invoices, payments, etc.

  • Information your browser makes available when you visit a PIEMPI website: IP address, the source of your site visit, time spent on the website or a particular page, links clicked, comments shared, browser type, date and time of visit, etc.

Use of Your Personal Data

We use your personal data to:

  • process and fulfill registration for trainings or orders for services and keep you informed about the status of your service request or your company’s order;

  • provide and administer our products and services;

  • provide member and customer support and process, evaluate and respond to requests and inquiries;

  • when needed, to conduct and facilitate customer satisfaction surveys;

  • conduct promotional and sales activities (including generating leads, pursuing marketing prospects, performing market research, determining and managing the effectiveness of our advertising and marketing campaigns and managing our brand);

  • send you organizational and marketing communications (such as emails, alerts, promotional materials, newsletters, etc.);

  • perform data analytics (such as market research, trend analysis, financial analysis, and customer segmentation). 

In providing marketing communication and advertisement, we will use available methods to build a profile based on data that we have obtained as described in this notice. You have the right to object to profiling activities by submitting a data subject request to: secretariat.piempi@gmail.com

We only collect the personal data from you that we need for the above purposes. We may also anonymize your personal data, so it no longer identifies you and use it for various purposes, including the improvement of our services and testing our IT systems.

 

Possible Results or Effects If You Do Not Provide or Request Us To Stop Processing Your Information

Some personal data is necessary to establish, conduct or terminate a business relationship with you. Your personal data may be required for the fulfillment of contractual obligations or which we are legally obligated to collect. We will not be able to establish, execute or terminate a contract with you without such personal data. In addition, we will not be able to accept requested pre-contractual measures to enter into a contract with you or to establish and continue the business relationship you have asked for. 

Legal Basis on the Use of Your Personal Data

We use your personal data for the purposes enumerated in this notice based on one of the following legal bases, when applicable:

  • We may process your personal data for the fulfilment of contractual obligations resulting from agreement with you or your company, or as part of pre-contractual measures requested;

  • We may process your personal data for statutory requirements, for example, on the basis of tax or reporting obligations, cooperation obligations with authorities or statutory retention periods;

  • When required by applicable law, we will ask for your consent on activities described in this privacy notice; or

  • We will rely on our legitimate interests to process your personal data within the scope of the business relationship with you or your company. Our legitimate interests to collect and use the personal data for this purpose are management and furtherance of the objectives of our organization.

Sharing of Personal Data 

It is not the policy of PIEMPI to share personal data we collect to any party for your protection unless legal procedures require us to do so.

Storage of Your Personal Data 

We will store your personal data for as long as necessary for the purposes described in this privacy notice, or until you notify us that you no longer wish to receive PIEMPI communication from us. After this time, we will securely delete your personal data, unless we are required to keep it in order to meet legal or regulatory obligations, or to resolve potential disputes.

Your Data Privacy Rights

Data privacy rights include the right to data access, right to data rectification, right to data erasure, right to restrict data processing, right to data portability, and the right to object to data processing. In certain circumstances, we may need to restrict the above rights to safeguard the public interest (e.g., the prevention or detection of crime) or our business interests (e.g., the maintenance of legal privilege).

Section 69 of RA 10173 also provides:

Interpretation. Any doubt in the interpretation of any provision of this Act shall be liberally interpreted in a manner that would uphold the rights and interests of the individual about whom personal data is processed.
